This involves attending industry events, participating in policy discussions, and collaborating with regulatory bodies to ensure smooth project approvals, access to grid infrastructure, and alignment with sustainability initiatives.
IRA - Inflation Reduction Act, Apprenticeship Compliance
Prevailing Wage Apprenticeship Requirement
The Inflation Reduction Act (IRA), signed into law on August 16, 2022, provides enhanced clean‑energy tax incentives for taxpayers who satisfy specific prevailing wage and apprenticeship requirements.
To meet the IRA’s prevailing wage requirement, taxpayers must ensure that all laborers and mechanics performing construction, alteration, or repair work on a qualified facility are paid no less than the applicable Davis‑Bacon prevailing wage rates, as determined by the U.S. Department of Labor.
To meet the IRA’s apprenticeship requirements, taxpayers must comply with both the participation and labor‑hours components:
- Participation Requirement: Any taxpayer, contractor, or subcontractor employing four or more individuals at any point during the construction, alteration, or repair of a facility must employ at least one qualified apprentice.
- Labor‑Hours Requirement: A minimum percentage of total labor hours on the project must be performed by Apprentices who are registered in an approved US Department of Labor or State Apprenticeship Agency Registered Apprenticeship Program (RAP). The Employer sponsoring the Apprentice is required to adhere to the prescribed Apprentice-to-Journey Worker ratio on a daily basis.
On June 25, 2024, the U.S. Department of the Treasury and the Internal Revenue Service issued the final rule governing compliance with the IRA’s prevailing wage and apprenticeship (PWA) requirements. Subsequently, the “One Big Beautiful Bill Act,” signed on July 4, 2025, accelerated the phase‑outs for Section 48E projects while maintaining tax incentives for other energy projects and preserving the PWA requirements.
